Waiver of Liability, Assumption of Risk, and Indemnity Agreement Waiver: In consideration for being permitted to participate in any way in the program hereinafter referred to as "FirstAnswers.com” I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue FirstAnswers.com, its officers, directors, founders, employees, and agents from liability from any and all claims now or in the future.
Assumption of Risk: I understand that there may be risks involved with participating in FirstAnswers.com and/or independently advertised or listed Coaches and/or Therapists, and I agree to assume full responsibility for those risks and any consequences should there be any. I agree to release, waive, discharge, and covenant not to sue FirstAnswers.com, its officers, directors, founders, employees, and agents from liability from any and all claims now or in the future.
Indemnification and Hold Harmless: I agree to INDEMNIFY AND HOLD FirstAnswers.com HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my participation in the program and to reimburse FirstAnswers.com for any such expenses incurred.
FirstAnswers.com Advertised and Listed Coaches: Trained and certified by FirstAnswers.com, Coaches are independent from FirstAnswers.com and self-employed. I agree to indemnify and hold FirstAnswers.com harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my participation in the program or with its Coaches and to reimburse FirstAnswers.com for any such expenses incurred. In the event I register as a FirstAnswers.com Coach, I agree to purchase and maintain any required programs, products, or fees necessary for me to function as a listed coach. I understand that failure to do so will result in the termination of my status as a FirstAnswers.com coach.
FirstAnswers.com Membership: In the event I order a FirstAnswers.com membership, I understand that this membership is to be maintained by me for listed time of the membership.. Unless other payment options are made available on the website, I understand that this service is paid for, upfront, by me, and I can not canceling the membership prior to the completion of the duration of the membership. I understand that after any membership I am previously enrolled in expires, I will no longer have access to the FirstAnswers.com membership and all related products/services associated with the membership.
FirstAnswers.com Advertised and Listed Licensed Mental Health Professionals and other Experts, “Experts”: I understand FirstAnswers.com Experts to be licensed marriage and family therapists, Registered Nurses, or Licensed Financial Planners in the state in which they have stated to be licensed to practice. I understand Experts are independent from FirstAnswers.com and choose to list and advertise their services on FirstAnswers.com. I understand all online communication with Experts to be a consulting service provided by the expert and not legal therapy. I agree to indemnify and hold FirstAnsers.com harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my participation in the program or its Experts and to reimburse FirstAnswers.com for any such expenses incurred.
I have read the previous paragraphs and I know and understand FirstAnswers.com and/or consultations with its Experts or Coaches to be an educational program for my personal use and is NOT licensed or professional therapy, provided by a psychologist, psychiatrist or any other professional. I hereby assert that my participation is voluntary and that I knowingly assume all such risks. I understand that FirstAnswers.com makes no guarantee of success regarding the participation in the programs. FirstAnswers.com is not intended in any way to replace professional therapy or mental health therapy. I further authorize FirstAnswers.com to use any communication I have through the site for promotional purposes. FirstAnswers.com agrees to post only my first name and/or state where I am located.
Severability: I further expressly agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Utah and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Governing Law: This agreement will be governed by the laws of the State of Utah.
Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, I have been provided the opportunity to seek independent counsel and I fully understand its terms, and understand that I am giving up substantial rights, including my right to sue.
